Conditions of Use

The University has granted to certain organisations ("providers") a license to use and to sublicense to third party Users a portion of the capacity of the University's HPC Facility ("Facility").

By using the Facility, the User agrees to the terms and conditions set out below.

  1. Users Responsible for own data

    The User is responsible for protecting his/her data from loss or corruption when using the Facilities.

  2. Confidentiality of data

    The User must respect and take all reasonable steps to preserve the confidentiality of data and intellectual property of other users. The University will instruct all staff and contractors of the University who have access to the Facility to respect and preserve the confidentiality of Users' data.

  3. Indemnities

    The User undertakes not to use the Facility in any way that would breach or infringe any intellectual property right of any person and agrees to indemnify the University, its staff and contractors from all actions, claims and demands

    1. by any person for infringement of copyright or infringement of patent
    2. any liability, loss, damage, cost or expense the University may suffer or incur arising out of or in connection with the use of the Facility by the User.

  4. Use of Internet and email

    The User acknowledges that the University is not an Internet service provider and undertakes not to use the Facility to access the Internet or to send and receive electronic mail, except, with the agreement of the University, to contact the User's provider.

  5. Compliance with law and University Statutes

    Users must comply at all times with relevant laws. Where the University has reasonable grounds to believe that the use of the Facility by the User constitutes or is related to the commission of an offence against any law, the University may terminate the access of the User to the Facility and take any steps that it considers necessary or desirable in reporting the matter to law enforcement authorities. The User acknowledges that such a report will not constitute any breach of confidentiality owed by the University to User.

    Users must comply with all relevant University Rules and Regulations, and in particular, Statute 8.1 Regulation 7 (Use of University Network Facilities) and Statute 8.1 Regulation 8 (Security of Local Area Networks).

  6. No warranty

    The User acknowledges that in using the Facility it has not relied on any representation or warranty by or from the University, including any representation or warranty as to the rights of the University to grant it access to the Facility or the suitability of the Facility for the particular purpose to which the User intends to put it.

    The User must make their own enquiries to determine whether the Facility will perform the functions required by the User.

    To the full extent permitted by law, any warranty, condition or representation (including any warranty, condition or representation as to the liability of the University) is expressly excluded and the University will not be liable for any act, omission or event wherein results in any loss, direct or indirect damage, cost charge or expense to the User. Under no circumstances will the University be liable for any consequential or incidental damages.

    Where the University has breached any mandatory warranty implied by law into these conditions and that breach causes errors in or loss of results, the University's liability will be limited to resupplying the services or payment of the cost of supplying the services to which the breach relates.

  7. No liability for delay

    The University will not be liable for any delay, interruption or breakdown in the Facility and will not be liable to the User for any loss which the User may suffer as a result of such delay, interruption or breakdown.

    However, where as the result of a breakdown in the Facility, material of the User is lost or damaged, and where the User provides to the University all source information in machine readable form necessary to make restoration of the material reasonably practicable, the University will attempt to restore the material.

  8. Shared Facility

    The User acknowledges that the Facility is made available by the University on a time share basis and that the share of the Facility available at any particular time will vary with load from other Users.
